General Terms & Conditions of Sale
1. Company Information, Scope of Terms & Acceptance
• These Terms govern the online sale of items by the Seller. Acceptance is strictly confirmed by the act of initiating an order and remitting payment. By paying, the Buyer unequivocally acknowledges that they have read and accepted these Terms in their entirety.
• The Seller reserves the right to modify these Terms at any time; the version in force at the time of payment governs the sale.
2. Product Description & Nature of the Items
Pre-owned & Period Item Provision:
Descriptions are provided to the best of the Seller’s knowledge. Buyers acknowledge these are second-hand or historical works. Natural wear, patina, and signs of use are inherent and do not constitute a defect.
Digital Media & Broadcasting Provision:
All photographic representations, digital videos, and live broadcasting sessions are for reference only. Variations in color or perceived dimension are inherent to digital capture and display; such variations do not constitute grounds for a refund.
Attribution & Liability Provision:
Attributions are stylistic opinions provided to the best of the Seller's knowledge. The Seller’s liability regarding the description or attribution of any item is strictly limited to a refund of the net purchase price actually received for the item.
Express Exclusions:
Under no circumstances shall the Seller be liable for transport, shipping, crating, import duties, "loss of investment value," or third-party expert fees.
3. Pricing and Taxes
• All prices are in EUROS (TTC) and exclude delivery fees.
International Customs Provision:
For non-EU buyers, all import taxes and duties are the Buyer's exclusive responsibility.
4. Orders and Payment
Availability:
All items are subject to availability. If an item becomes unavailable, the Seller’s liability is strictly limited to a refund of the amount received.
Final Sale:
Payment constitutes a firm and final commitment. Transfer of ownership occurs once the full price has cleared the Seller's bank. Goods will be handed to the carrier only after payment is received.
5. Shipping, Logistics & Transport Provision
Buyer Responsibility & Collection:
By default, the Buyer is responsible for the organization, booking, and payment of all transport and specialized crating services. The Seller will make the item available for collection at a time, date, and location set by the Seller, subject to the Seller’s availability.
• Collection requires the prior clearance of the full purchase price and a minimum of 48 hours' notice from the Buyer’s carrier.
Discretionary Service:
The Seller may optionally organize transport as a courtesy and at its sole discretion. In such cases, the Seller acts only as a facilitator for the Buyer.
Shipping Liability Provision:
The Seller is not liable for transit delays or damages once the item is handed over to the carrier. Shipping and packing fees are strictly non-refundable once initiated.
Transfer of Risk:
Risks pass to the Buyer upon handover to the carrier or the Buyer’s representative at the designated collection point.
6. Inspection Upon Delivery and Damaged Shipments
The Buyer must inspect the item in the presence of the carrier and record precise, reasoned reservations on the delivery slip. Failure to record reservations voids any claim for refund. Damage must be reported in writing within 48 hours.
7. Returns and Right of Withdrawal
Final Sale Provision (International & B2B):
For all buyers outside the EU and all professional/B2B buyers, ALL SALES ARE FINAL.
• EU Consumers Only: 14-day withdrawal right applies. Return shipping must be organized and paid by the Buyer via professional carrier. A restocking fee of up to 15% and deductions for depreciation may apply.
8. Statutory Guarantees
Guarantees & Limitations Provision:
Statutory guarantees apply to non-conformity and hidden defects. The legal presumption that a defect existed at delivery is limited to twelve (12) months. Approved claims are strictly limited to the original net purchase price.
Due to the age and individual character of the pieces, normal wear, restorations, and traces of time shall not be considered defects.
9. Intellectual Property
Copyright Provision:
All digital images, videos, and broadcasting content produced by the Seller are the exclusive property of the Seller.
Digital Conduct Provision:
Unauthorized recording or rebroadcasting of virtual viewing sessions is strictly prohibited.
10. General Limitation of Liability (The Global Provision)
• The Seller’s total liability shall not exceed the net amount actually paid by the Buyer for the item. The Seller shall not be liable for incidental, indirect, or consequential damages.
11. Force Majeure
• French law applies to these Terms, excluding conflict-of-law rules.
• Risk and all costs pass to the Buyer once the goods are handed to the carrier. Delivery times are indicative, and the Seller is not responsible for delays or extra costs caused by events beyond its control, including but not limited to strikes, transport disruptions, congestion, natural disasters, pandemics, wars, or government actions.
• Once the goods are shipped, the Seller has no further obligations, and cancellations or refunds are not allowed.
12. Privacy (GDPR)
• Data is processed for contract execution. This site does not use tracking cookies. Individuals have rights to access, correct, or delete their data.
13. Applicable Law and Jurisdiction
• These Terms are governed by French law.
Jurisdiction:
All disputes shall be brought before the exclusive jurisdiction of the Courts of Paris.
